Crime and fire log

Purpose

The purpose of this policy is to establish the university’s responsibility regarding the maintenance and public inspection of information in the crime and fire logs.

Policy

In compliance with federal law, the Department of Campus Safety maintains a daily crime log that records, by the date the incident was reported, all criminal incidents and alleged criminal incidents that have been reported to the university for the most recent 60-day period occurring either (a.) on campus, in or on non-campus buildings or property, (b.) on public property within the campus or immediately adjacent to and accessible from the campus, (c.) or within the patrol jurisdiction of the Department of Campus Safety.

In addition, the Department of Campus Safety, in compliance with federal law, maintains a fire log, which lists all fires in university housing that have been reported for the most recent 60-day period.

Definitions

Crimes—includes all crimes reported to the Campus Safety for the required geographic locations, included but not limited to Clery Act crimes. Fire—any instance of open flame or other burning in a place not intended to contain the burning or in an uncontrolled manner.

Required geographic locations—includes the Lynn University campus, non-campus buildings or property or public property within the campus or immediately adjacent to and accessible from the campus, and public property or within the campus patrol boundaries.

Procedures/Guidelines

I. Inspection of logs

The crime log is available for public inspection at the Campus Communication Center, located between Freiburger Residence Hall and E.M. Lynn Residence Hall. Upon request, the crime log's most recent 60-day period may be inspected at Campus Safety during normal business hours (8 a.m.-5 p.m.), Monday through Friday, unless the university is closed. Any portion of the log older than 60-days may be inspected at Campus Safety within two (2) business days of being requested. Logs are kept for seven (7) years.

The log includes the nature, date, time and general location of each crime reported to the department for the most recent 60-day period, as well as the disposition of the complaint, if the information is known.

The fire log component lists all fires in the university residence halls that have been reported to Campus Safety for the most recent 60-day period, including the following information: the date the fire was reported; the nature of the fire; the date and time of the fire; and the general location of the fire.

Campus Safety posts incidents in the daily crime and fire log within two (2) business days of receiving a report and reserves the right to exclude reports under certain circumstances. This includes crimes that are reported directly to Campus Safety, as well as crimes that are initially reported to another campus security authority or to a local law enforcement agency, which subsequently reports them to the Campus Safety. Note that if multiple crimes are committed during a single incident, all of the offenses must be recorded in the crime log.

II. Unfounded crimes

If a reported crime is fully investigated by sworn or commissioned law enforcement personnel, and, based on the results of the investigation, they make a formal determination that the crime report is false or baseless, Campus Safety will indicate in the log, as the disposition of the report, that the crime is “unfounded.” Only sworn or commissioned law enforcement authorities that investigate the crime can make this determination.
